Terms of Service

1. Agreement to terms

By registering for or using TenderAlerts MY ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and TenderAlerts MY.

2. Description of service

TenderAlerts MY is a tender monitoring and alert notification platform that aggregates publicly available tender information from Malaysian government and GLC procurement portals including ePerolehan, MyProcurement, CIDB, JKR, Petronas, and TNB. The Service delivers matched tender alerts to subscribers via Telegram and email based on their configured preferences.

The Service also provides a supplier directory and Request for Quotation (RFQ) tool for construction contractors and industrial suppliers.

3. Subscription plans and payment

TenderAlerts MY offers the following subscription plans:

• Starter (Free): limited to 10 alerts per month and 2 portal sources
• Professional (RM99/month): unlimited alerts, all 6 portals, instant Telegram alerts
• Team (RM249/month): all Professional features plus team workspace, RFQ tool, and market reports

Payments are processed monthly in Malaysian Ringgit (RM) via Billplz (FPX bank transfer) or Stripe (international cards). Subscriptions renew automatically unless cancelled before the next billing date.

Refund policy: we offer a full refund within 7 days of your first payment if you are not satisfied. After 7 days, no refunds are issued for the current billing period. You may cancel at any time to prevent future charges.

4. Acceptable use

You agree not to:

• Scrape, copy, or redistribute tender data from TenderAlerts MY to third parties
• Create fraudulent or multiple accounts to circumvent plan limits
• Attempt to reverse-engineer, hack, or disrupt the Service
• Use the Service for any unlawful purpose under Malaysian law
• Share your account credentials with individuals outside your registered team
• Submit false information during registration

We reserve the right to suspend or terminate accounts that violate these terms without prior notice and without refund.

5. Data accuracy and limitation of liability

TenderAlerts MY aggregates tender information from public procurement portals. While we make reasonable efforts to ensure data accuracy and timeliness, we cannot guarantee that all tender listings are complete, accurate, or up to date.

We are not liable for:

• Missed tenders due to portal downtime, scraping delays, or technical failures
• Inaccurate tender data sourced from third-party portals
• Business decisions made based on tender information provided by the Service
• Loss of contracts, revenue, or business opportunity

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.

6. Intellectual property

All content, software, and technology comprising the TenderAlerts MY platform is owned by or licensed to us. You may not copy, reproduce, or create derivative works from any part of the Service without our written permission.

Tender data sourced from public portals remains the property of the respective government agencies and GLCs. TenderAlerts MY claims no ownership over such data.

7. Account termination

You may cancel your account at any time by contacting us at hello@tenderalerts.my. Upon cancellation, your account will be downgraded to the Starter plan at the end of your current billing period. Your data will be retained for 3 years per our Privacy Policy, after which it will be permanently deleted.

8. Modifications to the service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuala Lumpur as the agreed venue for arbitration proceedings.
